Terms of Service

These terms govern your use of Duka Digitali ("the Site", "we", "us"), an online marketplace where creators ("Sellers") sell digital products to customers ("Buyers"). By using the Site, placing an order, or opening a seller account, you agree to these terms. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 18 years old, or have the permission of a parent or guardian, to buy or sell on the Site. Buyers do not need an account: an order only needs a mobile-money phone number. Sellers need an account and must be approved by us.

2. Buying

• Prices are shown in TZS. Payment is made by mobile money: you enter your phone number and approve a payment prompt (USSD) on your phone with your PIN. We never see or store your PIN.
• Your order is complete when the payment is confirmed. Digital products are made available immediately after that. Nothing is shipped.
• You are responsible for entering a phone number that belongs to you and has enough balance.
• Discount codes follow the conditions shown with them (for example expiry, minimum spend, usage limits) and cannot be exchanged for cash.

3. Downloading your files

• Download window. Files can be downloaded for siku 3 after payment. When the window closes, downloads close and cannot be restarted from the Site. Please download and keep your files straight away.
• Your link and order code. After payment you receive a personal download link and an order code. Within the window you can use your phone number and order code, or your email, on the "Find my downloads" page to get your link again. Keep your order code private: anyone who has your phone number and code can open your downloads.
• Each purchased item can be downloaded up to 10 times during the window.
• If a problem on our side stops you from downloading, contact us and we will fix it or refund you (see the Refund Policy).

4. Licence and acceptable use

When you buy a product you receive a personal, non-exclusive, non-transferable licence to use it, unless the product page says otherwise. You may not resell, share, publish or redistribute the files, or share your download link or order code with others. We may close access to orders that we reasonably believe are used for fraud or abuse.

You may not misuse the Site: no attempts to break or overload it, to guess other people's links or codes, to scrape it, to use stolen payment accounts, or to upload harmful or unlawful content.

5. Sellers

• Approval. Seller accounts and each new product (and each replaced file) are reviewed by us before they appear on the Site. We may reject, hide or remove a product or suspend a seller at our discretion, for example for quality, legality, rights or safety reasons.
• Your content. You must own or have the right to sell everything you upload. Products must not infringe anyone's rights, contain malware, or be unlawful, misleading, hateful or sexually explicit. You keep ownership of your products and grant us the right to host, display, promote and deliver them to Buyers.
• Fees. The Free plan has no monthly fee and we keep a commission of 10% of each sale (after discounts). The Basic plan costs TZS 10,000 per 30 days and the commission is 7%. The Pro plan costs TZS 30,000 per 30 days and the commission is 4%. The commission rate that applies is fixed on each sale when it is made. The Free plan allows up to 10 products, Basic up to 25 and Pro is unlimited. Paid plans do not renew automatically. If a plan ends, your account returns to the Free plan.
• Payouts. Your earnings are the sale price after discounts minus our commission. You can request a payout once your balance reaches TZS 5,000. We pay to the mobile-money number you give us, normally by manual transfer, and mark the payout as paid in your dashboard. You are responsible for any taxes on your income.
• Refunds. If we refund a Buyer, the earnings from that sale are taken back from your balance. If you have already been paid, the amount is deducted from your future earnings.
• Discounts. Coupons you create apply only to your products and the discount is paid from your earnings.

6. Refunds

Refunds are covered by our Refund Policy, which forms part of these terms.

7. Accounts and security

Keep your password safe and do not share it. Administrators and sellers may be asked to use two-factor authentication. You are responsible for activity on your account. Tell us immediately if you think it has been accessed without permission.

8. Availability and our responsibility

We work to keep the Site running but cannot promise it will always be available or error-free. Products are provided by Sellers; we do not guarantee that a product will meet your particular needs. To the extent allowed by law, we are not liable for indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it. Nothing in these terms limits liability that cannot be limited by law, including your rights as a consumer.

9. Changes and ending

We may update these terms from time to time; the date above shows the latest version. Continuing to use the Site after a change means you accept it. We may suspend or close accounts that break these terms.

10. Governing law

These terms are governed by the laws of the United Republic of Tanzania, and the courts of Tanzania have jurisdiction, unless mandatory consumer law in your country says otherwise.
